The Centers for Medicare and Medicaid Services (CMS) had first stated that RPM codes could not be implemented “incident to” a physician’s service, but then later revised the rule and allowed “incident to” billing of RPM services by auxiliary personnel under direct supervision. An “incident to” services refers to a service done under the physician’s supervision, and billed to Medicare in the physician’s name. The revised rule allowing for direct supervision means that the auxiliary personnel must be in the same building as the physician at the same time, although not necessarily in the same room.
Effective January 1, 2020, CMS will allow RPM reimbursements for RPM services furnished “incident to” under general supervision, meaning that the auxiliary personnel and physician need not be in the same building at the same time, and can instead use telemedicine to exercise general supervision.
